If your flat, plot or family house in Delhi is caught in a dispute, the first step you take matters more than the next ten. A Property lawyer in Delhi reads the paper trail (sale deed, chain of title, mutation, possession) before the other side makes a move that is hard to undo. At Ricky Chopra & Co., our Property advocate in Delhi team has handled title disputes, partition suits and illegal possession cases since the firm was founded in 1972. This guide explains what a property lawyer does, when to hire one, and how to choose the best property lawyer in Delhi for your case.
What Does a Property Lawyer in Delhi Do?
A property lawyer in Delhi verifies ownership, drafts and vets property documents, and represents clients in civil and criminal proceedings over land, flats, shops and inherited property. The work runs from pre-purchase title checks to suits for possession, partition, injunction, cancellation of deed and specific performance in the Delhi District Courts and the Delhi High Court.
In practice, a property advocate in Delhi does five things:
- Checks the title chain and encumbrances before you pay.
- Drafts or reviews sale deeds, agreements to sell, gift deeds, wills and lease deeds.
- Files or defends civil suits and seeks urgent injunctions.
- Pursues criminal complaints where forgery or cheating is involved.
- Negotiates settlements when litigation is not the smartest route.
When Should You Hire a Property Advocate in Delhi?
Hire one before the dispute hardens. The common triggers are:
- You are about to buy a flat or plot and the seller’s papers look incomplete.
- A relative has sold or mortgaged a share of ancestral property without telling you.
- A tenant has stopped paying rent or refuses to vacate.
- Someone has occupied your vacant plot or flat.
- A builder has missed the possession date.
- You hold a GPA, Will or “agreement to sell” and want to know whether it actually gives you ownership.
Delay costs real money here. A suit to cancel a fraudulent sale deed generally has to be filed within three years of learning about it, and a specific performance suit within three years of the agreement date or refusal. Waiting turns a winnable case into a limitation fight.
Step 1: Title Verification Before You Buy
Most property litigation in Delhi begins with a purchase that was never properly verified. Before you pay a token amount, a property lawyer near you in Delhi should confirm:
- Chain of title: an unbroken line of registered documents from the original allottee or owner to the present seller.
- Nature of holding: freehold, DDA leasehold, co-operative society, Lal Dora or unauthorised colony. Each has different transfer rules.
- Registration: under the Transfer of Property Act, 1882 and the Registration Act, 1908, a sale of immovable property above ₹100 must be by registered deed. A GPA, Will or agreement to sell does not transfer ownership, as the Supreme Court held in Suraj Lamp & Industries v. State of Haryana (2011).
- Encumbrances: mortgages, pending litigation, attachments, unpaid dues, and conversion or mutation status.
- Possession: whether the seller is actually in possession, or a tenant or a family member is.
The usual mistake in Mayur Vihar, Laxmi Nagar and Patparganj is relying on a broker’s photocopy. Insist on originals and run the title search yourself.
Step 2: Sale Deed Disputes and Property Fraud
Property fraud in Delhi typically takes a few forms: a forged signature on a sale deed, the same plot sold to two buyers, an impersonator posing as the owner, or a GPA used after the owner has died. These cases have a civil side and a criminal side, and a good lawyer runs both together.
On the civil side, we file for declaration and cancellation of the deed with a stay on further alienation. On the criminal side, a complaint can be pursued under the Bharatiya Nyaya Sanhita provisions on cheating (Section 318) and forgery (Section 336), often before the Economic Offences Wing. Our criminal litigation team under Resham Singh, Head of Criminal Litigation and a former IPS officer, works alongside the civil team so the evidence trail stays consistent. Read more about how we handle the criminal angle at Best Criminal Lawyer in Karkardooma.
Step 3: Ancestral Property Disputes and Partition Suits
Partition disputes are the most emotionally expensive property cases in East Delhi, Shahdara and Vivek Vihar, where multi-storey family homes have been passed down for decades.
Two points decide most of them:
- Daughters are coparceners. After the 2005 amendment to Section 6 of the Hindu Succession Act, and the Supreme Court’s ruling in Vineeta Sharma v. Rakesh Sharma (2020), a daughter has the same coparcenary rights as a son in joint Hindu family property.
- Self-acquired versus ancestral. A parent can freely will away self-acquired property. Ancestral property follows different rules. The label on a property usually decides the case.
A partition can be done by a family settlement or partition deed, or by a partition suit where there is no agreement. If you are a co-owner whose share is being denied, a property lawyer in Delhi can file for partition, ask for an interim injunction against sale, and request a local commissioner to inspect the property.
Our family and succession work is covered in more detail on our Family Law page.

Step 4: Illegal Possession and Property Grabbing
If someone has occupied your property, speed and paperwork are everything. Under Indian law, you cannot take back possession by force, and you should not try. The route is:
- Legal notice to the occupant, which also creates a record.
- Suit for possession and injunction under the Specific Relief Act and CPC, supported by an application for interim protection.
- Police complaint if there is criminal trespass, threats or forged documents behind the occupation.
- Mesne profits claim for the period you were kept out.
A suit for possession based on title has a 12-year limitation period from the date of dispossession, but waiting that long makes evidence harder to prove. In Rohini, Dwarka and West Delhi, where vacant plots and NRI-owned flats are frequent targets, we advise owners to keep updated property tax receipts, electricity bills and a caretaker’s record.
Step 5: Builder-Buyer Disputes
Delayed possession, changed layouts, extra charges and refund refusals are the main complaints. Buyers have three forums:
- RERA: the Real Estate (Regulation and Development) Act, 2016 gives you the right to delay interest or refund on registered projects. See our explainer, A Detailed Explanation of the MahaRERA Act, for how the authority works.
- Consumer Commission: for deficiency in service and refund claims.
- Civil court: for specific performance and damages where the contract so allows.
Aasma Sachdeva, Counsel at Ricky Chopra & Co., focuses on real estate and construction laws and appears before RERA, Consumer Courts and the District Courts across Delhi NCR. Vineet Jain and Arushi Kochhar also handle real estate litigation for buyers in Dwarka, Noida and Gurgaon. Picking the right forum first saves a year.
Step 6: Landlord-Tenant Disputes
Delhi’s landlord-tenant law is unusual. The Delhi Rent Control Act, 1958 still applies to premises with monthly rent up to ₹3,500, and eviction there is possible only on the grounds in Section 14, such as non-payment, subletting or genuine personal need. For higher-rent premises, the Transfer of Property Act and the lease terms govern, and recovery of possession is through a civil suit.
For landlords in Central Delhi and South Delhi with older tenancies, the big risk is an old unregistered rent agreement. For tenants, it is eviction without notice. A property advocate in Delhi can examine the agreement, send the right notice and file the petition in the correct court.
Our Agreement Drafting in Delhi service covers lease deeds and rent agreements that actually hold up in court.
Step 7: Inheritance, Wills and Succession
Property in Delhi is often stuck because the owner died without clear papers. The key questions are:
- Is there a registered Will? A Will needs proper attestation, and contested Wills often turn on the testator’s capacity and the witnesses.
- If no Will, which law applies? Hindus are governed by the Hindu Succession Act, 1956, Muslims by personal law, and others by the Indian Succession Act, 1925.
- Mutation and probate: after succession is settled, the property has to be mutated in the municipal or DDA records.
Nishant Solanki, Senior Counsel at Ricky Chopra & Co., practises in the Delhi High Court and handles civil matters including property law and land acquisition. His experience helps in succession disputes that cross from the District Court to the High Court.

How to Choose the Best Property Lawyer in Delhi
The best property lawyer in Delhi is not the one with the loudest advertising. It is the one who reads your documents carefully, tells you the weak points of your case, and has real courtroom experience in your forum.
Check these points before you hire:
- Property-specific experience. Ask how many partition, possession and title cases the lawyer has actually argued.
- Court coverage. Your case may start at Karkardooma and end up in the Delhi High Court. The firm should be comfortable in both.
- Document-first approach. A serious lawyer asks for your papers before quoting an outcome.
- Honest assessment. If your claim is time-barred or weak, you should hear it in the first meeting.
- Clear fee structure. Fees, stages and expected hearings should be explained upfront.
- Accessibility. You should be able to reach the team, not just an intake desk.
What Makes a Top Property Lawyer in Delhi Different
A top property lawyer in Delhi combines litigation skill with transactional care. The same firm that argues your injunction should also be able to draft the settlement deed that closes the dispute. Ricky Chopra & Co. has practised since 1972, and our Chairman and Chief Counsel, Mr. Ricky Chopra, brings experience in complex commercial and transactional disputes. Property clients also benefit from the firm’s corporate, criminal and civil teams working under one roof, which matters when a land dispute involves a company, a loan or a fraud complaint.
You can meet the lawyers on our team page.

Frequently Asked Questions: Property Lawyer in Delhi
Q1. Where can I find a property lawyer in East Delhi for title and possession disputes?
A property lawyer in East Delhi handles title verification, illegal possession, partition and sale deed disputes for properties in this region. Ricky Chopra & Co. has its Delhi II office at Manjusha Chamber, Saini Enclave, Vikas Marg, Karkardooma. Bring your sale deed, mutation papers and any notice received for a first review.
Q2. Can a property advocate in East Delhi help if a relative has sold our ancestral house without my consent?
Yes. A property advocate in East Delhi can file a suit for declaration, cancellation of the sale deed and permanent injunction, and can seek a stay on further transfer. Because a suit to cancel a deed generally has a three-year limitation from the date of knowledge, you should consult a lawyer as soon as you find out.
Q3. What does a property lawyer in Shahdara do for a family partition dispute?
A property lawyer in Shahdara examines whether the property is ancestral or self-acquired, identifies each co-owner’s share and then pursues a family settlement or files a partition suit. Since the 2005 amendment, daughters also hold equal coparcenary rights in joint Hindu family property. Interim orders can restrain a co-owner from selling or mortgaging the property.
Q4. Is a property advocate in Shahdara useful before buying a flat or builder floor?
Yes. A property advocate in Shahdara checks the chain of title, registration, mutation and encumbrances, and whether the seller is actually in possession. Many disputes in builder floors and old colonies begin with an unregistered agreement or a GPA transfer, which does not by itself pass ownership.
Q5. How do I choose a property lawyer in Preet Vihar for a sale deed dispute?
Choose a property lawyer in Preet Vihar who asks for your documents first, explains the limitation period for your claim and has experience in the Karkardooma Courts and the Delhi High Court. For sale deed disputes, the lawyer should be able to run the civil suit for cancellation and the criminal complaint for forgery together.
Q6. What can a property advocate in Preet Vihar do about illegal occupation of my flat?
A property advocate in Preet Vihar can send a legal notice, file a suit for possession and injunction, claim mesne profits and, where forgery or trespass is involved, pursue a police complaint. You should not retake possession by force. The correct legal route protects your title and keeps the evidence in your favour.
Q7. Why hire a property lawyer in Mayur Vihar before signing an agreement to sell?
A property lawyer in Mayur Vihar can verify the seller’s title, check whether the society or authority permits the transfer, and draft an agreement to sell with clear payment stages and default clauses. This prevents the common problem of paying a large advance on a property that is mortgaged, disputed or not registrable.
Q8. Can a property advocate in Mayur Vihar handle builder delay and refund cases?
Yes. A property advocate in Mayur Vihar can advise whether your case belongs before RERA, the Consumer Commission or a civil court. Under the Real Estate (Regulation and Development) Act, 2016, buyers of registered projects can claim delay interest or a refund. The right forum depends on your agreement and project status.
Q9. What kind of cases does a property lawyer in Laxmi Nagar usually handle?
A property lawyer in Laxmi Nagar commonly handles landlord-tenant disputes in commercial shops, multi-storey builder floor ownership issues, sale deed disputes and partition among family members. Where the old Delhi Rent Control Act applies, eviction is possible only on the statutory grounds. For higher rent premises, recovery of possession is through a civil suit.
Q10. Can a property advocate in Laxmi Nagar help a tenant who received an eviction notice?
Yes. A property advocate in Laxmi Nagar can check the rent agreement, the monthly rent, the notice served and the ground claimed by the landlord, and then defend the petition or negotiate a settlement. Keep your rent receipts, bank transfer proofs and the rent agreement ready for the consultation.
Q11. When should I consult a property lawyer in Patparganj?
Consult a property lawyer in Patparganj when you receive a notice about your property, discover an unknown entry in the records, face a co-owner’s refusal to partition, or are about to buy or sell. Early advice protects your claim within limitation and helps you collect the documents before the other side creates facts on the ground.
Q12. How does a property advocate in Patparganj deal with GPA and Will based ownership?
A property advocate in Patparganj will first confirm whether you hold a registered sale deed. Following the Supreme Court’s ruling in Suraj Lamp & Industries v. State of Haryana, GPA, agreement to sell and Will based transactions do not by themselves transfer ownership. The lawyer can then advise on regularising title or filing a suit.
Q13. Is there a property lawyer near me in Anand Vihar for urgent matters?
Yes. A property lawyer in Anand Vihar can act quickly on urgent matters such as an attempted dispossession, a forged document, or a sale being made behind your back. The usual step is a legal notice followed by a suit with an application for interim injunction. Call Ricky Chopra & Co. on +91-88008 55555 to discuss your situation.
Q14. What is the role of a property lawyer in Karkardooma Courts?
A property lawyer in Karkardooma appears in civil suits for possession, partition, injunction and declaration relating to properties in East and Shahdara Delhi. The lawyer prepares the plaint or written statement, leads evidence and argues interim applications. Ricky Chopra & Co.’s Delhi II office is located in Karkardooma, near the courts.
Q15. Can a property advocate in Karkardooma help with property fraud and forged documents?
Yes. A property advocate in Karkardooma can file a civil suit to cancel the forged document and, along with it, a criminal complaint for cheating and forgery under the Bharatiya Nyaya Sanhita. Running both tracks together prevents inconsistent statements and helps you obtain interim protection over the property.
Q16. How can a property lawyer in Vivek Vihar help with an ancestral property dispute?
A property lawyer in Vivek Vihar can trace how the property devolved, determine whether it is ancestral or self-acquired, and file for partition if the family cannot agree. The lawyer can also seek an injunction against sale during the case. Documents such as the family tree, old deeds and Wills should be brought to the first meeting.
Q17. What should I check with a property lawyer in Dilshad Garden before buying a plot or flat?
Ask a property lawyer in Dilshad Garden to verify the registered sale deed, the earlier chain of title, mutation, property tax payment, and any pending litigation or loan on the property. Also confirm who is in physical possession. A title check done before payment is far cheaper than a dispute after it.
Q18. Why consult a property lawyer in Rohini for a possession dispute?
A property lawyer in Rohini understands the practical requirements of the Rohini District Courts and can move quickly where a vacant plot or flat has been occupied. The lawyer can issue a notice, file a possession suit and seek interim protection. Keep property tax receipts, electricity bills and ownership papers ready to prove your title.
Q19. Can a property advocate in Rohini assist with landlord-tenant and builder disputes?
Yes. A property advocate in Rohini can advise landlords on eviction and recovery of rent, tenants on protection from wrongful eviction, and buyers on delay or refund claims against builders. The first step is to identify the correct forum, whether it is a civil court, the Rent Control framework, RERA or a Consumer Commission.
Q20. Who is the right property lawyer in Dwarka for a group housing or flat buyer dispute?
A property lawyer in Dwarka who regularly handles cooperative group housing, builder-buyer and sale deed matters, and who appears before the Dwarka District Courts, is the right choice. You can also read about our work on the Property Lawyers in Dwarka page.
Q21. Can a property advocate in Dwarka help an NRI owner whose flat has been occupied?
Yes. A property advocate in Dwarka can act on behalf of an NRI owner through a duly executed power of attorney, send a notice, file for possession and injunction, and pursue a criminal complaint if forged papers were used. The owner should send scanned copies of the title documents before the first consultation.
Q22. What disputes does a property lawyer in South Delhi typically handle?
A property lawyer in South Delhi typically handles high-value title disputes, partition of large family properties, lease and tenancy issues, and cases that move to the Delhi High Court. Property cases in this region are usually heard at the Saket Courts. Suits valued above ₹2 crore can be instituted in the Delhi High Court.
Q23. Is a property advocate in South Delhi needed for a registered Will dispute?
Yes, where a Will is challenged. A property advocate in South Delhi can examine the Will’s execution, attestation and the testator’s capacity, and can file or defend probate and declaration proceedings. Contested Wills are fact-heavy, so the original Will, witness details and medical records of the testator matter a great deal.
Q24. How can a property lawyer in Central Delhi help with an old tenancy near Connaught Place?
A property lawyer in Central Delhi can examine the old rent agreement, determine whether the Delhi Rent Control Act applies, and advise on eviction, rent revision or settlement. Ricky Chopra & Co.’s main Delhi office is at ICP Thapar House, 124 Janpath, Connaught Place. Bring the lease or rent papers and rent receipts.
Q25. What can a property lawyer in West Delhi do if a co-owner refuses to partition the property?
A property lawyer in West Delhi can serve a notice, try a family settlement, and, if that fails, file a partition suit with a request for an interim injunction and a local commissioner to inspect the property. The case is typically supported by title documents, a family tree and proof of possession.
